ZERO DEAN ("ZEROTOPIA") IMAGE LICENSE AGREEMENT

Zero Dean caters to individuals and small businesses by providing many 'Images' (photographs) as "royalty free" for production runs under 250 copies (unless specifically noted).

In the event that more than 250 copies of an image may be required, you will need to obtain a "Resale License" or a "Rights Managed" license.

A "Resale License" is required whenever the primary content in the media you create is for resale.

"Rights Managed" images are purchased for a specific, clearly defined used and the price is determined by the scope of that use. "Rights Managed" 'Images' (photographs) are available for mass publication, advertising, editorial, and design purposes. Specific pricing for rights managed photos is based on media type, anticipated exposure, and usage length. In the case where exclusivity may be an issue, a sales history of every image is maintained in order to avoid possible conflict.

All images on Zero Dean's website (www.zerotopia.com), DVDs and CD-ROMs are proprietary and copyrighted. Each reproduction of any image must bear a credit line "© Zero Dean".

All rights are reserved by Zero Dean. This license is granted only to the registered owner of a Zerotopia 'Image' (photograph), DVD or CD-ROM. Your invoice is the proof of your registration.

In no event will Zero Dean be liable to you for any consequential, incidental or indirect damages (including damages for loss of business profits, business interruption and the like) arising out of the use or inability to use the software.

Permitted Usage

By this agreement Zero Dean grants to the registered owner the non-exclusive, non-transferable right to use the an 'Image' (photograph) with a 'Web License' use for website, multimedia design projects, and electronic presentations.

Zero Dean grants to the registered owner of an 'Image' (photograph) with a 'Full Commercial License' use for advertising, packaging, marketing, brochures, presentations in production runs requiring less than 250 copies.

License Restrictions

You may not copy or distribute copies of the Images, documentation, or packaging to others.

You may not sub-license, sell, re-sell distribute, or provide to others any portion of the files from any DVDs, CD-ROMs or photographs.

You may not use any Zero Dean Image in any form of pornographic, defamatory, immoral or illegal material.
